Terms of Service

These Terms are provided as a template for review with legal counsel before publication. The SMS Terms section below is written to satisfy the disclosure requirements of A2P 10DLC and toll-free SMS verification programs (including Twilio's review).
1. Acceptance of these terms
By creating a Tagaby account, activating a Tagaby tag, or otherwise using the Tagaby website, applications, or services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service is operated by Telaeris, Inc. ("Tagaby", "we", "us", "our"), based in San Diego, California, United States.
2. The Service
Tagaby provides QR and NFC tags that owners attach to belongings. When a finder scans a tag, the Service allows them to contact the owner so the item can be returned. The Service also includes a dashboard and mobile applications for managing tags, organizations, and lost-and-found activity.
3. Accounts
- You are responsible for the accuracy of the information you provide and for maintaining the security of your account.
- You must be 18 or older (or the age of majority in your jurisdiction) to hold a Tagaby account.
- You are responsible for all activity that occurs under your account.
- Notify us at [email protected] immediately if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Send abusive, threatening, harassing, deceptive, or unwanted messages through the Service;
- Misrepresent ownership of an item or attempt to claim a tag that is not yours;
- Interfere with or disrupt the Service, attempt to gain unauthorized access, or probe for vulnerabilities without permission;
- Use automated means to access the Service except as expressly permitted.
5. SMS / text messaging program
The Tagaby SMS program is part of the Service. When you provide a mobile phone number and consent during account registration, tag activation, or as a finder responding to a lost item, you may receive SMS messages from Tagaby as described below.
5.1 Program description

Program name: Tagaby Account & Lost-Item Notifications
Description: Transactional messages related to your Tagaby account, tags, and lost-and-found activity.
5.2 Types of messages
- Account verification one-time passcodes (OTP);
- Notifications that a finder has scanned your tag or sent you a message;
- Replies and updates within a lost-and-found conversation you initiated;
- Operational messages such as password resets and security alerts.
5.3 Message frequency
Message frequency varies based on activity on your account and on the tags you own. Most users receive only a handful of messages per month; periods of active lost-and-found activity may produce more.
5.4 Cost
Message and data rates may apply. Tagaby does not charge for SMS messages, but your mobile carrier's standard rates will apply based on your plan.
5.5 Opt-in
You opt in to the SMS program by entering your mobile phone number and checking the SMS consent checkbox on a Tagaby form (tag activation, finder contact, or account registration). No purchase is required to participate. Opt-in is per-flow and tied to the phone number you provide.
5.6 Opt-out and help
You can cancel the SMS program at any time. Reply STOP to any Tagaby message and you will no longer receive SMS messages from us. We will send one final message confirming you have unsubscribed. After that, no more messages will be sent to your number.

5.7 Supported carriers
The Tagaby SMS program is available on major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint (now T-Mobile), U.S. Cellular, Boost, MetroPCS, Virgin Mobile, Cricket, and others. Carriers are not liable for delayed or undelivered messages.
5.8 Privacy
Mobile information (phone numbers and SMS opt-in consent) will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how we handle your information.
6. Tags and hardware
Physical Tagaby tags are sold separately. When you activate a tag, you become its registered owner in the Service until you transfer or deactivate it. Tagaby is not responsible for lost items that are not returned despite the Service operating correctly.
7. Organizations and schools
If your tag is registered to a school or organization, that organization's administrators may have access to certain information about the tag, including the item description and your name and contact information. Organizations are responsible for their own use of that information.
8. Intellectual property
The Tagaby name, logo, software, and content are owned by Telaeris, Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or for other legitimate business reasons. Surviving provisions (intellectual property, liability, dispute resolution) continue after termination.
10. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Tagaby disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. Tagaby is not liable for indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the Service.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in San Diego County, California.
